Criminal Sexual Conduct in the 4th degree, MCL 750.520e is punishable by up to 2 years in prison and is considered a High Court misdemeanor.  However it is treated like a felony and requires registration on the Sex offenders registry.

All of the above offenses require registration on the Sex Offenders Registry, MCL 28.723.  There are exceptions allowed for registration depending upon the nature of the Sex Crime, age of the actors and consent.  This is commonly known as a “Romeo and Juliet” exception where to young actors within 4 years age of each other engage in a sexual act.  The exceptions are listed in the applicable statue, MCL 28.723a.

Sexual Assault claims are very serious.  An individual can be wrongfully accused or simply overcharged.  It is not uncommon for an individual to be accused because of a variety of reasons.

Our real case histories have shown the many human factors that can cause a false claim of a sex crime. Our client was accused of having sexual intercourse with a minor.  He contacted Barrix Law prior to speaking with the police.  We were able to keep him from being charged when we showed that what had really transpired was a false claim, coached by a parent to try and stop the father from exercising his parenting time.  There is no doubt that had he spoken to the Detective without the benefit of counsel he would have been charged with a life offense.  Our investigation showed there was no physical evidence or corroborating evidence of a sex crime.

We were able to produce other false claims by the parent against the other parent to stop parenting time.  We employed private investigators, polygraph operators (Lie detector tests), forensic experts and doctors to help defend the wrongfully accused.

It is crucial to employee an attorney well experienced in Sex Crimes laws immediately upon being contacted by the police.  The biggest mistake an accused can do is think they can explain their side and the case will simply go away.
